Illinois EPA's New MS4

Illinois EPA (IL EPA) has issued a new version of its NPDES Permit No. ILR40 (MS4 Permit). The new permit became effective on March 1, 2016. 

IL EPA’s new permit contains a variety of new and modified requirements that will impact local stormwater management programs. SMC has reviewed the new permit, compared it to the previous permit, summarized the changes, and evaluated what the changes appear to mean for Lake County MS4s. This information is available below:

As the new permit takes effect, SMC remains committed to providing a variety of stormwater management activities across the county and to assisting Lake County's MS4s in meeting the requirements of IL EPA's NPDES Municipal Stormwater Program.  Please contact 847-377-7700 if you should have any questions about IL EPA's new permit or municipal stormwater program. 

Stormwater Management Program Plan (SMPP) Template

SMC revised their SMPP template in order to comply with IL EPA's General NPDES Permit No. ILR40 issued on March 1, 2016. The SMPP includes substantial changes from the previous template. If you previously created a SMPP, it may be most effective to revise the new SMPP template to coincide with MS4 specific changes rather than updating your existing SMPP. Utilize track changes in the new template to carefully review and update all document text as appropriate and address all margin review comments. Please also review/address all "How To Use" comments at the front end of the SMPP template.

Permittees have until August 28, 2016 (i.e., 180 days from the effective date of the permit) to determine how the new permit impacts their existing stormwater management efforts and make the changes needed to bring their programs into compliance with the new permit. Accordingly, each MS4 should be in the process of revising/adopting the updated SMPP by August 28, 2016. In their annual reports due June 1, 2017, permittees must describe how they have modified their programs in order to bring them into compliance with the requirements of the new permit.

Notice of Intent (NOI) Template, Spring 2016


IL EPA’s new MS4 Permit contains a variety of new and modified requirements that will impact local stormwater management programs.

The new permit also states that permittees are required to submit a new Notice of Intent (NOI) by May 30, 2016 (i.e., 90 days of the effective date of the permit) in order to renew their coverage under the new permit, unless they had previously submitted a NOI for coverage under the new permit. IL EPA has confirmed that permittees that submitted a NOI in late summer/early fall 2013 (or shortly thereafter) to extend coverage under the old permit – as well as request coverage under the new permit – as well as coverage under the new permit - do not need to submit a new NOI by May 30, 2016. Therefore, permittees that used the NOI template provided by SMC in late summer/early fall 2013 (see below) to prepare and submit a NOI at that time do not need to submit a new NOI at this time.

However, permittees who did not submit a NOI in late summer/early fall 2013 (or shortly thereafter) do need to submit a new NOI to IL EPA by May 30, 2016.

Annual Reporting Template, Year 13


Below is this year’s customizable annual reporting template, which can be used to create your Year 13 Annual Facility Inspection Report (i.e., Annual Report). Before using the template to create your Annual Report, please carefully review the information provided in the red, dashed boxes preceding each part of the template. These boxes provide useful information and helpful tips for completing your Annual Report. They should be deleted prior to submitting your report to IL EPA.

In addition to completing your Annual Report, you should also complete and sign IL EPA’s Annual Facility Inspection Report Form. The Form may be placed on top of your Annual Report, as a cover sheet, to create your reporting packet.

As a reminder, your reporting packet (i.e., Annual Facility Inspection Report Form & Annual Report) should be sent to IEPA by no later than June 1, 2016.  The packet should be submitted directly to IEPA using the following e-mail address: epa.ms4annualinsp@illinois.gov; there is no need to submit a copy to SMC.

Notice of Intent (NOI) Template, Late Summer/Early Fall 2014


IL EPA has confirmed that permittees that submitted NOIs in late summer/early fall 2013 (to extend coverage under the old permit as well as request coverage under the new permit) do not need to submit a new NOI by May 30, 2016. Therefore, permittees that used the NOI template provided by SMC to prepare and submit their NOIs at that time do not need to submit a new NOI at this time, as that NOI template indicated that permittees were seeking coverage under the new permit. Municipal Advisory Committee


The countywide approach that has been taken toward the implementation of IL EPA’s NPDES Municipal Stormwater Program in Lake County places SMC in the role of a Qualifying Local Program (QLP). In this role, SMC proactively formed the MAC as a way to coordinate the efforts of Lake County MS4s during implementation of IL EPA’s NPDES Municipal Stormwater Program. SMC continues to facilitate MAC meetings and to provide general support to Lake County MS4s as they implement their stormwater management programs.   

 

Municipal Pollution Prevention/Good Housekeeping
